1. Acceptance and eligibility
These Terms of Service ("Terms") are between you and Woosoo Pty Ltd, based in Sydney, New South Wales, Australia. They govern your use of the Lumo mobile app, website, and related services (collectively, “Lumo”). By using Lumo, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Lumo.
You must be at least 18, or the age of legal majority where you live, to create an account or make purchases. Lumo is designed for parents and adult caregivers, not for children to operate independently. You are responsible for supervising a child’s use of any printed activity.
2. The Lumo service
Lumo turns text ideas, photos, and voice-transcribed ideas into printable coloring, tracing, drawing, story, and related activities. Features may include private libraries, printing, bookmarking, community sharing, free generation allowances, flowers, subscriptions, and one-time flower packs.
We may add, change, suspend, or discontinue features and may impose reasonable limits to protect quality, safety, and availability. Internet access and a compatible device may be required.
Your account
You are responsible for activity under your account and for keeping access to your Apple or Google sign-in secure. Provide accurate information, do not impersonate others, and notify us if you suspect unauthorised access.
3. Free use, subscriptions, and flower packs
- Lumo may provide a free creation allowance. The amount and availability can change.
- Garden Pass is an auto-renewing subscription unless the purchase screen expressly says otherwise. Available benefits, billing period, and current price are shown before purchase.
- Flower packs are one-time in-app purchases that add virtual flowers used for eligible generation actions.
- Flowers have no cash value, are not transferable, and cannot be redeemed outside Lumo. We may correct balances affected by error, fraud, refunds, or chargebacks.
- Apple or Google processes payment. Their account, billing, cancellation, and refund rules apply. Unless required by law or an app-store policy, purchases are non-refundable.
- Deleting Lumo or your Lumo account does not automatically cancel a subscription. Manage or cancel it in the relevant app-store account.
Lumo does not currently promise a free subscription trial. If a trial or promotion is offered in the future, its specific terms will be shown before you subscribe.
4. Your inputs and generated activities
You retain your rights in photos, ideas, and other content you submit (“Inputs”). You confirm that you have all permissions needed to submit Inputs, including permission concerning people depicted and intellectual-property rights.
You grant Lumo a limited, worldwide licence to host, copy, process, adapt, and transmit Inputs and generated activities only as needed to operate, secure, improve, and support Lumo and to follow your sharing choices.
As between you and Lumo, Lumo does not claim ownership of your Inputs. To the extent permitted by applicable law, you may use generated activities for personal and classroom purposes. AI output may not qualify for copyright protection, and Lumo cannot grant rights in third-party people, characters, brands, or material that may appear in an Input or output.
5. Community sharing
Creations are private by default. If you submit a generated activity to the community:
- You ask us to moderate it and, if approved, display it publicly in Lumo, on our website, and in Lumo promotional or discovery surfaces.
- You grant Lumo a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute, and format that shared activity for those purposes.
- You confirm the activity is suitable for a family audience and does not expose personal information or violate another person’s rights.
- We may reject, de-rank, label, or remove community content, but we do not promise to review every item.
- You may request removal by contacting us. Removal may not immediately eliminate cached, backed-up, legally retained, or previously distributed copies.
Community actions such as bookmarks, flowers or reactions, moderation records, and related counts form part of shared activity history. They are not automatically removed if the person who made them later deletes their account, although applicable privacy rights and the removal process in our Privacy Policy still apply.
Do not use community features to identify, contact, or profile a child.
6. Acceptable use
You must not use Lumo to:
- Create, upload, or share unlawful, exploitative, sexually explicit, hateful, violent, harassing, deceptive, or privacy-invasive material.
- Upload images of a child or another person without appropriate authority or consent.
- Infringe copyright, trademark, publicity, privacy, or other rights.
- Attempt to access another account, bypass safeguards or usage limits, interfere with the service, distribute malware, scrape at scale, or reverse engineer Lumo except where law expressly permits it.
- Resell access, flowers, accounts, or generated services, or use automated means to create unreasonable load.
We may block generation, remove content, adjust fraudulently obtained benefits, or suspend accounts when reasonably necessary to enforce these Terms or protect users and the service.
7. AI-generated content
AI output is probabilistic and may be incomplete, inaccurate, unexpected, or unsuitable. You must review each activity before printing, sharing, or giving it to a child. Lumo does not guarantee that an output will match an Input, be unique, be free of third-party material, or be appropriate for every age or situation.
Lumo is a creative tool, not medical, educational, legal, safety, or other professional advice. Do not rely on it for critical decisions.
8. Lumo intellectual property
Lumo and its software, branding, interface, original artwork, site content, and service technology are owned by or licensed to us and protected by law. Except for the limited right to use the service under these Terms, no rights are transferred to you.
Feedback is voluntary. If you provide it, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.
9. Suspension, termination, and deletion
You may stop using Lumo or request account deletion at any time. Account deletion removes your active profile, private creations, retained source uploads, and private generation records. It does not automatically remove community interactions involving other users' activities, including bookmarks, flowers or reactions, moderation records, and related counts. We may suspend or terminate access if you materially breach these Terms, create safety or legal risk, misuse purchases, or threaten service integrity. Where practical, we will provide notice and an opportunity to address the issue.
Termination does not cancel obligations already incurred, app-store subscriptions, or provisions that by their nature should survive, including content licences for copies that cannot reasonably be recalled, payment terms, disclaimers, and limitations of liability.
10. Disclaimers and limitation of liability
Lumo is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted, secure, or error-free operation.
To the maximum extent permitted by law, Lumo and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or opportunities arising from Lumo. Our aggregate liability for claims relating to Lumo will not exceed the greater of US$100 or the amount you paid for Lumo in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes rights, guarantees, or liabilities that cannot lawfully be excluded or limited, including applicable consumer-law rights.
11. Third-party services
Lumo relies on services from Apple, Google, Firebase, RevenueCat, OpenAI, and other providers. Their terms and policies may apply to your use of their services. We are not responsible for third-party services outside our reasonable control.
If you obtained Lumo through Apple, Apple is not a party to these Terms, is not responsible for Lumo or its support, and is a third-party beneficiary of the provisions applicable to the iOS app. Your use must comply with the applicable app-store rules.
12. Changes and general terms
We may update these Terms to reflect product, legal, or operational changes. We will post the revised Terms and update the date above, with additional notice where required. If you do not accept a material change, stop using Lumo.
If any provision is unenforceable, the remaining provisions continue. Our failure to enforce a provision is not a waiver. You may not transfer your account or these Terms without our consent; we may transfer these Terms as part of a reorganisation, financing, merger, or sale of the service.
These Terms are governed by the laws of New South Wales, Australia. Subject to any rights you have under mandatory consumer law, the courts of New South Wales have jurisdiction over disputes relating to these Terms. Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.
