Terms of Use

1Agreement

These terms are between you and Woosoo Pty Ltd, based in Sydney, New South Wales, Australia (“Lumo”, “we”, “us”). They cover the Lumo app (Lumo Family Album) and our websites. By using Lumo you agree to them and to our Privacy Policy. If you don’t agree, please don’t use Lumo.

You must be at least 18, or the age of legal majority where you live, to create an account or make purchases.

2Your album

Lumo is a private photo album for one family. You own the photos and videos you add. You give Lumo permission to store them, make viewing copies, show them to the people in your family album, and, when someone in your family asks, create magic versions. This permission ends when the content is deleted, except for copies we can’t reasonably recall, such as images already on another member’s device.

Only add photos and videos you have the right to share with your family, and photos of other people only where you’re allowed to.

3Your family

Everyone in a family album can see, add, heart and comment on its photos. Anyone in the family can invite people, and anyone in the family can approve a request to join, so invite people you trust.

Someone in the family can share a single photo by link with a person outside the album; anyone with that link can view it for a limited time. You can leave a family album, or delete your account, at any time.

4Free, Lumo Pass and flowers

• The album is free: unlimited photos and videos, for everyone in the family, with no ads, subject to fair use (below). Videos on the free plan play their first minute; the whole file is kept.
• Lumo Pass is an auto-renewing subscription, yearly or monthly. One Pass covers everyone in the family album. It adds full-length video playback, unlimited magic (subject to fair use), and downloading original files.
• The yearly plan may start with a free trial. After the trial, you’re charged the price shown at purchase each period until you cancel.
• Payment is charged to your Apple ID. The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Manage or cancel it in your App Store account settings. Deleting the app or your Lumo account doesn’t cancel it.
• Flowers are a one-time purchase used for magic without Lumo Pass. They have no cash value and can’t be transferred or refunded by us, except where the law requires.
• Refunds for App Store purchases are handled by Apple under its policies.
• If you subscribed to the earlier Lumo coloring app, that subscription now gives your family Lumo Pass while it stays active.

5Fair use

Lumo is a family photo album, and “unlimited” means unlimited for that: the photos, videos and magic of an everyday family, with no fixed cap. It isn’t a promise of unlimited storage or computing for any purpose.

Fair use rules out, for example:

• using Lumo as general file storage or backup, or for files that aren’t your family’s photos and videos
• storing or sharing photos for a business, a client, an organisation or the public
• uploading, downloading or making magic in bulk or with automated tools, scripts or bots
• volumes far beyond what a family would normally create, or that put the service at risk for other families
• sharing, selling or renting accounts, family albums or Lumo Pass outside your family

If an account or family album goes beyond fair use, we may contact you, limit uploads, downloads or magic, or suspend or close the account or album. Where practical, we’ll tell you first, explain why, and give you a chance to change how you use Lumo and to download your photos. Unlimited magic with Lumo Pass is subject to the same fair use.

6Magic

Magic uses AI image models to make new versions of your photos. Results can be imperfect or unexpected, and may not look exactly like the people in them. Magic is for fun and keepsakes: don’t use it to deceive anyone or to pass off an edited image as a real record.

Magic won’t create harmful or deceptive images of real people, and we may decline a request that would break these terms.

7Be kind

Don’t use Lumo to:

• upload anything illegal, abusive, sexual, hateful or violent, or anything that exploits or endangers children
• share photos or videos you don’t have permission to share
• harass, impersonate or deceive anyone
• try to get into albums you weren’t invited to, or to break, overload or reverse engineer Lumo

We may remove content, or suspend or close accounts, that break these rules, go beyond fair use, or put people or Lumo at risk. Where practical, we’ll tell you first and give you a chance to fix it.

8Lumo’s part

The Lumo app, its design, its magic templates and the Lumo name belong to us. You may use them only to use Lumo as intended.

9Availability, and our responsibility

We work hard to keep your photos safe and the app running, but Lumo is provided “as is” and “as available”, and we can’t promise it will always be uninterrupted or error-free. Keep copies of photos that matter to you; with Lumo Pass you can download every original.

To the extent the law allows, we aren’t liable for indirect or consequential losses, or for lost data, profits or opportunities, and our total liability for any claim about Lumo is limited to the greater of US$100 or what you paid us for Lumo in the 12 months before the claim. Nothing in these terms excludes or limits rights you have that can’t lawfully be excluded, including under the Australian Consumer Law.

10Apple and other services

Lumo relies on services from Apple, Google, RevenueCat, OpenAI and others, whose own terms may apply. Apple is not a party to these terms and isn’t responsible for Lumo or its support, but Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. The Apple Standard End User License Agreement also applies to your use of the app.

11Changes and general terms

If these terms change in a way that matters, we’ll tell you in the app before the change takes effect. If you don’t accept a change, stop using Lumo and delete your account.

If part of these terms can’t be enforced, the rest still applies, and not enforcing a term isn’t a waiver. You can’t transfer your account or these terms without our consent; we may transfer them as part of a reorganisation or sale of Lumo. These terms are governed by the laws of New South Wales, Australia, and, subject to your rights under consumer law, its courts handle disputes about them.
